Article 1 – Who We Are

Article 2 – Applicability and Agreement

  1. These terms and conditions govern every offer and remote agreement between the entrepreneur and any consumer made via the website cre8magnets.com.
  2. By using this website and placing an order, you acknowledge that you have read, understood, and accept these terms and conditions and our privacy policy.
  3. Cre8Magnets reserves the right to amend these terms at any time. The revised terms become effective once published on the website, and your continued use of the website constitutes your acceptance of them.

Article 3 – Service Description

Cre8Magnets specializes in the production and sale of personalized magnets based on images and designs provided by the customer.

Article 4 – Pricing and Payment

  1. Prices are expressed in euros, inclusive of VAT, and do not include shipping costs.
  2. Any shipping fees will be clearly shown during checkout, prior to placing your order.
  3. Orders are processed only after full payment is made through the secure payment options provided, such as Bancontact or credit card.

Article 5 – Exclusion of Cancellation Rights for Personalized Items

  1. Under Article VI.53 12° of the Belgian Code of Economic Law, the right of withdrawal does not apply to products that are custom-made and clearly personalized.
  2. The magnets produced by Cre8Magnets are highly personalized based on the photos and designs you provide. These products have no value to third parties and cannot be resold.
  3. By placing your order, you expressly acknowledge and accept that you forfeit your right of withdrawal for these personalized products. You confirm this during the ordering process by actively agreeing to this clause.
  4. Exercising this exception to the right of withdrawal does not prejudice your rights to a warranty in case of non-conformity, as set out in Article 9.

Article 6 – Shipment and Delivery

  1. Once your payment has been received, an order confirmation will be sent to you via email.
  2. The entrepreneur will dispatch orders as promptly as possible. Delivery times are estimates only and do not form a contractual obligation. Delays caused by force majeure (e.g., strikes, natural disasters, supplier problems) shall not entitle you to any compensation.
  3. Risk of damage or loss of the products passes to the customer once the carrier has delivered them.
  4. It is your responsibility to provide an accurate and complete delivery address. Packages returned to us due to an incorrect address can be resent at your cost.

Article 7 – Intellectual Property and User-Generated Content

  1. All content on the website (including designs, logos, text, and software) is owned by Cre8Magnets or its licensors and is protected under Belgian intellectual property law.
  2. Production License:
    When you upload images, designs, or text (“User Content”), you confirm that you either own the intellectual property rights or have permission to use them, and that they do not violate any third-party rights.
    By submitting User Content, you grant Cre8Magnets a limited, non-exclusive license to use it only for creating and fulfilling your order.
  3. License for Promotional Purposes (Marketing):
    Default Policy: Unless you actively opt out via the designated checkbox during checkout, you grant Cre8Magnets a limited, non-exclusive, royalty-free license to use your User Content (or a photo of the final product) for promotional and marketing purposes, online (website, social media, ads) and offline (brochures, trade shows).
    Opt-Out: If you check the box to indicate that you do not agree to the use of your content for promotional purposes, this license for promotion is immediately void. Your User Content will only be used for the production of your order and will not be shared or published thereafter.
  4. Regardless of whether you grant permission for promotional use, we will never publish personally identifiable information (such as your name or address) alongside your User Content without your separate, explicit consent.
  5. You release Cre8Magnets from all liability for claims by third parties related to the content you provide.

Article 8 – Refund Policy

  1. In case of non-conformity (warranty): If a product does not conform to the agreement and you make a warranty claim, the return shipping costs will be covered by us. Upon acknowledgment of the non-conformity, we will refund the full purchase amount (including shipping costs) via your bank account, wich you provide to us. We do not refund to the original payment card because of the associated high costs.
  2. Cancellation before production: If you cancel an order by email before production has started, the order can be cancelled and the amount refunded.
  3. After Production: Because our products are personalized, orders cannot be cancelled or refunded once production has started, which happens shortly after your payment is confirmed.

Article 9 – Product Compliance and Warranty

  1. Cre8Magnets guarantees that its products comply with the agreement, satisfy reasonable quality expectations, and/or correspond to the specifications listed on the website.
  2. All products are subject to the legal warranty for conformity under the Belgian Code of Economic Law (at least 2 years). Any defect appearing within 12 months of delivery is presumed to have existed at the time of delivery.
  3. If a defect occurs, please reach out to our customer service at info@cre8magnets.com. We will either repair the product, provide a replacement, or refund your purchase.

Article 10 – Limitation of Liability

In any event, Cre8Magnets’ liability is limited to the value of the order. We shall not be responsible for any indirect damages, including lost profits or business interruptions.

Article 11 – Governing Law and Dispute Resolution

  1. These terms and conditions are governed exclusively by Belgian law.
  2. In the first instance, disputes shall be submitted to the competent court at the entrepreneur’s registered location.
  3. The European Commission provides an Online Dispute Resolution (ODR) platform: https://ec.europa.eu/odr. We neither have the obligation nor the intention to take part in dispute settlement procedures before a consumer disputes commission.
